The terms that govern your use of lauchey.com and purchases from Lauchey.
These Terms & Conditions (“Terms”) govern your access to and use of the website located at www.lauchey.com (the “Site”) and your purchase of products from LAUCHEY INTERNATIONAL TRADE LTD. (“Lauchey,” “we,” “us” or “our”), a company organized under the laws of the State of California, USA, with its principal place of business at 1801 E Holt Blvd #1194, Ontario, CA 91761. By accessing the Site or placing an order, you agree to be bound by these Terms.
You must be at least 18 years old and able to form a binding contract to place an order. By placing an order you represent that the information you provide is accurate, current and complete.
We make every effort to display product descriptions, colors and pricing accurately. Product images are for illustration; actual items may vary slightly due to natural materials and handmade finishes. We reserve the right to correct typographical or pricing errors and to change or discontinue products at any time without notice. All prices are in US Dollars (USD).
An order is accepted when we send an order confirmation. We may refuse or cancel any order at our discretion, including orders that appear to be fraudulent, in error or in violation of these Terms. Payment is due at the time of purchase using the payment methods offered on the Site. Wholesale orders may be subject to separately agreed payment terms.
Risk of loss passes to you upon delivery of the products to the carrier, except where otherwise required by applicable law. Shipping dates are estimates only and are not guaranteed. Our shipping policy is described on our Shipping & Returns page.
Returns are governed by our Shipping & Returns policy, which is incorporated into these Terms by reference.
Our products are selected and documented to comply with applicable US consumer product safety requirements for their category. Consumers should follow all care and use instructions provided with each product. Electrical products must be installed in accordance with local codes and, where applicable, by a qualified electrician.
The Site and all of its contents — including text, graphics, logos, images, product photography and software — are the property of Lauchey or its licensors and are protected by US and international copyright, trademark and other intellectual property laws. You may not reproduce, distribute, modify or create derivative works from any part of the Site without our prior written consent.
You agree not to use the Site for any unlawful purpose or in any way that could damage, disable or impair the Site, including attempting to gain unauthorized access, scraping content at scale, or interfering with the Site’s normal operation.
The Site and all products are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted or error-free.
To the maximum extent permitted by law, Lauchey shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Site or purchase of products. Our total liability for any claim arising out of or related to these Terms or your purchase shall not exceed the amount you paid for the products giving rise to the claim.
You agree to indemnify and hold harmless Lauchey and its officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles, and applicable federal law of the United States. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in San Bernardino County, California, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any rights you may have under applicable consumer protection law.
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
These Terms, together with our Privacy Policy and Shipping & Returns policy, constitute the entire agreement between you and Lauchey regarding your use of the Site and purchases of products, and supersede all prior agreements and understandings.
